It is a world adventure trip, visiting at least three continents in 16 days. So it is an intensive programme. Adventure activities will also be undertaken, accessible to those without experience. However, a good physical state of mind is a requirement. Think sandboarding, a jungle trek or scuba diving.

It is an adventure world tour also in terms of accommodation and care. So don't expect luxury hotels.

Buyers have the chance to win a trip around the world (across at least three continents), or another adventure (e.g. mountain biking, kite surfing) by entering the code on the First Energy gum pack and stating the funniest, funniest, most appealing motivation as to why exactly they want to win this prize.

Definitions

Promotion 

"Win an Adventurous World trip for 2 people or one of the other adventures."

The trip 

The trip to be won as further described in Article 7.

Buyer(s) 

The person(s) who purchased a First Energy Gum during the promotional period.

Code(s) 

The code which the Buyer finds on the back of the First Energy Gum packaging during the promotional period and has entered and submitted at www.firstenergygum.nl in accordance with the promotional terms and conditions.

Participant(s) 

Buyers who participate(s) in the Promotion by entering their Code(s) and thereby accepting the promotion conditions.

Prize Winner(s) 

The participant whose entry is chosen in accordance with Articles 5 and 6 and his or her chosen travel companion.

Promotion Period / Participation Period

The period during which Buyers can enter their Code(s) to participate in the Promotion, namely 15 February 2024 (00:00) to 31 May 2024 (23:59).

1. Applicability

1.1 These Additional Terms and Conditions apply exclusively to the (win) promotion "Win an adventurous World Trip for 2 persons or one of the other adventures" by First Energy Gum.

1.2 In the event of discrepancies between the General Promotion Terms and Conditions and the Additional Terms and Conditions, what is set out in the Additional Terms and Conditions shall apply. These Additional Terms and Conditions of Promotion and the General Terms and Conditions of Promotion are hereinafter jointly referred to as "Terms and Conditions of Promotion".

1.3 By participating in the Promotion, participants declare that they have read and agree to the Promotion Terms and Conditions and agree to the rights and obligations arising therefrom.

3.Participation

3.1 The participant can participate in a Promotion during the promotion period.

3.2 First Energy B.V. reserves the right, without prior notice, to terminate, interrupt, extend or modify games and/or to change the Action terms and conditions and/or the prizes if circumstances so require, without in any way having the obligation to compensate participants.

3.3 Participation in this Promotion is subject to a different age limit. When registering for the Promotion or before a prize is awarded, the participant's date of birth or a copy of a valid ID may be requested.

3.4 During the Participation Period, participants can enter their code, requested data and personal motivation via the Promotion page on the website www.firstenergygum.nl. Each unique participant offers the possibility of participation. Participants with multiple unique codes can therefore participate multiple times within the Participation Period.  Participants can participate once a month within the participation period if they enter multiple unique codes.

3.5 The participant must:

Be at least 21 years old at the start of the Promotion; and

In possession of a valid passport; and

Have a permanent place of residence in the Netherlands; and

Provide the requested (contact) details and information completely and correctly; and

To be in good physical condition to undertake adventurous activities, as well as a busy travel schedule.  

3.6 If the Participant is selected as a Prize winner of a Promotion, he and the travel companion designated in advance by the Participant agree to the use and/or publication of his profile picture, in any manner whatsoever, in connection with promotional activities by First Energy B.V..

3.7 Employees of First Energy B.V. and other partners of the relevant Promotion are expressly excluded from participation.

4. Participation costs

There are no costs associated with participating in this promotion other than the made purchase of a First Energy Gum pack.

5. Determination of winners

5.1 Winners will be chosen based on the following criteria: 

Participant made a purchase of First Energy Gum product during the promotional period; and

Participant correctly submitted the product code during the participation period; and

Participant entered the requested information completely and correctly; and

Participant has submitted the best entry / motivation, at the sole discretion of First Energy B.V.

5.2 For this promotion, 1 winner of the main prize (World Trip) and 4 winners of the other prizes (adventures such as mountain biking, kitesurfing packages) will be designated. 

5.3 Each participant guarantees that the (personal) data provided are correct and complete. If a participant has provided incomplete and/or incorrect (personal) data, First Energy B.V. has the right to exclude the participant from further competition and may decide to forfeit the right to the prize to be won.

5.4 In case of fraud or unlawful influence on the Promotion, First Energy B.V. has the right to exclude participants, not to pay out prizes or to drop the right to the prize (afterwards).

5.5 First Energy B.V. is at all times entitled to exclude participants from participation without giving reasons.

6. Announcement of winners

6.1 After the Promotion Period, no later than 15 June 2024, one Participant will be selected from all entries to win the grand prize for 2 persons. This person will be notified via email or telephone. The winner may also be announced via First Energy B.V.'s website and on social media. During the promotional period, a different adventure prize will also be chosen every month. This will be done after each month, no later than the 5th of the following month.

6.2 The result of the Promotion is binding and non-appealable. No correspondence can be entered into about the results.

6.3 First Energy B.V. will contact the winning participant(s) as soon as possible, but in any event within three weeks of the results being known via the contact details provided. If a winner cannot be reached, First Energy B.V. will designate a subsequent winner in the same manner in which the original winner was designated. In that case, the original winner may no longer claim the prize or any compensation or reimbursement.

6.4 First Energy B.V. can under no circumstances be held responsible for the submission of an incorrect telephone number, e-mail or home address by the participant.

6.5 First Energy B.V. reserves the right not to award a Prize to a Participant who expresses himself during the Promotion in violation of the law, good morals or public order.

7. The prizes

7.1 Several prizes may be won through the Promotion. There is one main prize which will be awarded no later than 15 June 2024 to one of the participants who may hereafter call himself the winner and take one person on a trip who also fulfils the conditions set out in article 3.5.

7.2 A trip around the world is offered as the main prize. The main prize includes (indicatively) the following activities for 2 persons:

Air tickets to multiple destinations across three continents.

Day activities such as sandboarding, deep-sea diving, jungle safari and excursions

15-16 overnight stays in adventurous mid-range locations

Transport

The following costs are expressly not included in the Price:

Optional excursions

Three meals per day 

Travel and cancellation insurance

Travel documents and visa 

All consumptions unless expressly stated otherwise above

Excluding transport from winner's home address to airport and back to home address

7.3 The ANVR travel conditions apply to the prize to be won.

7.4 The details of the trip are subject to change and will be arranged with the travel organisation in consultation with the winner after the running time of the prize draw. The prize will have to be cashed in 2024 and must be coordinated with the travel organisation by 15 July 2024 at the latest. The trip will preferably take place in September/October. The organisation will come up with three proposals for a travel period (outside school holidays). The winner should choose one travel period from these. If this cannot be chosen, the grand prize will go to another winner. The trip cannot be paid out in cash. 

7.5 Each prize is personal and therefore not transferable to third parties. If the winner is unwilling or unable to accept a prize in the form in which it is offered and/or the winner does not comply with the conditions set out in article 3.5, the right to the prize lapses. First Energy B.V. is not liable for any circumstances preventing the prize from being redeemed.

8. Indemnification

8.1 First Energy B.V. is responsible for the execution of the prize. Participation in the activitites is at your own risk. Other prizes (adventure packages) will be carried out by external parties. Their conditions will then apply. 

8.2 The prize will be awarded in its condition. First Energy B.V. will not be liable for any visible or hidden defects in the prize, nor for any damages incurred in the performance of the prize.

8.3 A prize won is personal, unique and non-transferable and is not redeemable for cash, goods and/or services. If a prize is unexpectedly unavailable, the winner will receive a replacement prize if possible. The winner cannot then claim the original prize or any reimbursement or other compensation.

8.4 Costs for obtaining a valid travel document (passport and visa), driving licence and credit card with PIN in Participant's name, any travel and cancellation insurance, pocket money and refreshments will be borne entirely by the Participant, unless otherwise stated.

8.5 The Prize may be cancelled due to unforeseen circumstances.

8.6 First Energy B.V. is not liable for any damage and loss of Prize winners and/or their property during the trip.

9. Gaming tax

First Energy B.V. will arrange for the handling and direct payment of the compulsory gaming tax on the value of the Prize to the tax authorities.

10. Cooperation of participant

10.1 If requested, prize winners will cooperate in promotional activities relating to the Promotion such as photograph or film recordings and interviews. First Energy B.V. will then be entitled to publish and/or reproduce these photo or film recordings and interviews in any manner whatsoever. First Energy B.V. shall owe no compensation to the Participant(s) for this.

10.2 The Participant and his/her travel companion grant First Energy B.V. unconditional permission in advance to use his/her name and the image and/or audio material expressly concerning the Participant, whether or not in abridged or edited form, for the production, broadcast and promotional purposes of the Promotion, irrespective of the medium, duration and frequency.

10.3 This also includes the (re)use of the image and/or audio material in (advertising) communications of or on account of the Campaign and in follow-up campaigns.

10.4 The Participant waives all claims that could be enforced against First Energy B.V. and its affiliated legal entities and persons on account of the use for which permission is granted under the Campaign Conditions.

10.5 The permission granted as described in this article is an explicit condition for participation in the Promotion.

10.6 One or more trip leaders will accompany the winners during the entire trip. This person will also take video and photo material during the trip for the purposes of a travel report and other aforementioned purposes.

11. Exclusion from participation

11.1 Employees of First Energy B.V., and other partners of the relevant Promotion are excluded from participation.

11.2 First Energy B.V. reserves the right to exclude or disqualify participants from participation at any time without giving reasons, in particular if they fail to comply with the Promotion terms and conditions or otherwise act unlawfully towards First Energy B.V. or third parties.

11.3 Participants with a postal address outside the Netherlands are excluded from participation.

11.4 Participants under 21 years of age are not entitled to participate in this Promotion.

12. Privacy

12.1 Participation in the Promotion implies the processing of the Participant's personal data in order for First Energy B.V. to inform the Participant, for example regarding the progress of the competition. All personal data obtained from participants in connection with the Promotion will be treated in strict confidence and in accordance with First Energy B.V.'s privacy and cookie statement. 

12.2 Personal data will be kept in First Energy B.V.'s winners file. The personal data of prize winners will be kept for seven (7) years in connection with tax legislation. The personal data of non-award winners will be kept for one (1) year. First Energy B.V. will not further pass on the data to third parties, except in case they are requested by the authorities.

12.3 By participating in the Promotion, the participant also agrees that his or her data may be made available to the prize sponsor(s) and any other partners of the Promotion. The participant has the right to request that his or her data be removed from the database at any time with the exception of the material obtained in accordance with Article 10 of these terms and conditions.

13. Liability

13.1 Except in cases of intent or gross negligence, First Energy will not be liable for any damages of any kind incurred by the entrant and/or winner as a result of participation in the Promotion, including but not limited to damages resulting from:

inability to participate in the Promotion;

exclusion from participation or disqualification;

defects in the prize;

use of the prize provided;

late receipt of the prize;

minor discrepancies in the prize received compared to the published prize;

damage or loss of the prize during shipment;

inability to use the prize;

the receipt of the prize by an unauthorised person.

13.2 Any printing, spelling, typesetting or other such errors in material published by First Energy B.V., of whatever nature, cannot be held against First Energy B.V. and in no way create an obligation for First Energy B.V..

14. Changes

14.1 First Energy B.V. reserves the right to unilaterally amend these General Terms and Conditions of Promotion and the additional terms and conditions of a specific Promotion, without prior notice or further notification afterwards.

14.2 A revised version of the Promotion terms and conditions will be announced or otherwise communicated as soon as possible at the time of the Promotion.

14.3 First Energy B.V. reserves the right to terminate the Promotion at any time without giving reasons and/or to change the communicated, prices, Promotion period and/or additional Promotion terms and conditions.

15. Complaints

15.1 For complaints or queries, please write to info@firstenergygum.nl unless otherwise provided in the additional terms and conditions. 

15.2 When submitting a complaint, it should clearly state:

which Promotion it concerns;

through which medium the Promotion was announced;

the content of the complaint.

15.3 First Energy B.V. endeavours to deal with any complaints and queries within 14 days of receipt provided that they are submitted correctly.

Slot

16.1 If the Promotion qualifies as a promotional game of chance within the meaning of the Code of Conduct for Promotional Games of Chance, the Promotion will be organised in accordance with this Code of Conduct.

16.2 These Promotion Terms and Conditions are governed by Dutch law. Any disputes arising herefrom shall be settled by the competent court in Rotterdam.

16.3 In all cases not provided for in these Promotion Conditions, First Energy B.V. will decide.
